Will Transcript

IN THE NAME OF GOD AMEN the twenty second day of July in the year of our Lord one thousand seven hundred & Ninety Two I, James Dickey of Rutherford County in the State of North Carolina in the eightieth year of my age being weak and low in body yet considering myself sound enough in mind and memory to make my will thanks be given to God therefore and calling to mind the mortallity of my body knowing that it is appointed for all men anew to die and after that to come to judgement & remembering the uncertainty of all earthly enjoyments do make and ordain this to be my last Will & Testament first recommending my soul into the hands of Almighty God who gave it to me & do allow my body to be restored to its original & Mother Earth in a decent & Christian manner at the discretion of my Executor. Nothing doubting but I shall receive the same again at the general resurrection by the mighty power of God and as touching such worldly estate where with it hath pleased God to bless me in this life.
I give devise and dispense of the same in the following manner & form in the first place allowing all my just debts and funeral charges to be paid and as it is uncertain how long it may please God to continue me in this world likewise particular.
I do allow and it is my will that my dear wife Mary have her life estate and all the estate and greathouse and herd of the cattle household furniture to be her own and at her disposal if she lives.
Also give and bequeath to William Barr my grandson my young grey horse and a young cow that is known by being called his. All the remaining part that should be at my decease I do allow to be sold after my decease, whether odds & chattel or lands & tenements the time and manner of which sale I do leave to the discretion of my executor & any lands should be disposed of by virtue of this my last will.
I do hereby authorize my executor & empower him to make sufficient deed or deeds to the same to the purchaser or if he my said executor shall agree to & will the other Legatees to pay their equal parts of the value of such land then by this my Last Will & Testament I do allow the right to remain in him and I do hereby allow after all is sold an equal division to be made between my beloved children that is to say Isabel Ferguson, Anthony Dickey, Margaret Hughes, Martha Dickey my daughter in law & David Dickey my son whom I appoint whole & sole Executor of this my Last Will & Testament & I do hereby revoke and disband all former Wills Bequeaths & Execution before by me named or made ratifying this and no other to be my Last Will & Testament.
